Documentation Requirements for a CER

The CER shall, at a minimum, contain the following:

bulletThe date the CER was completed.
bulletA description of the proposal that was evaluated.
bulletA statement indicating that the proposed action has been evaluated with respect to the potential for meeting any of the exclusion exception criteria listed in the Departmental Manual.
bulletA statement indicating that as a result of the evaluation the MMS has determined that the proposed action either,
  1. does not meet any of the exception criteria for categorical exclusions and, therefore, does not require the preparation of either an EA or an EIS, or
  2. may meet at least one of the exception criteria and, therefore, requires an EA or an EIS.
