Consistency

CZMA - What is “Consistency”?

After NOAA approves a State’s Program, the State can review Federal actions, licenses, or permits for “Federal consistency.”  “Federal consistency” is the requirement that those Federal actions likely to affect any land/water use or natural resources of the coastal zone be consistent with the Program’s enforceable policies.  There are two standards for Federal consistency:

  1. “consistent to the maximum extent practicable” with enforceable policies—direct Federal activities must meet this standard. 

  2. “consistent with” enforceable policies—Federal license and permit activities and OCS Plans must meet this standard.
